Duty of Care and Compliance Issues

Legislation within the UK and Europe is becoming more and more complex regarding health and safety and duty of care by the employer. The legislation can be difficult to understand and the associated costs in staying on the right side of the law are escalating.

And it's likely to continue...

If your employees drive while at work it is possible that you might not be aware of all the current legislation surrounding this aspect of work. The health and safety guidelines that apply to ALL business journeys no matter if the employee is a regular driver or not and regardless of if the vehicle they drive is owned by the company or the employee (a grey fleet vehicle). The health and safety executive's 'driving at work' publication (INDG382) is published in association with the department of transport.

If your company decides to ignore the guidelines then your company is exposed to prosecution under the Corporate Manslaughter and Corporate Homicide Act of 2007 in the event of a fatal accident involving either an employee but extends also to any member of the public killed by employees while in the course of their duty.

The legislation has severe penalties for employees, managers or directors including prosecution as individuals with fines up to £20,000 or TWO YEARS IMPRISONMENT under the health and safety offences act of 2009 in ANY accident whether fatal or otherwise.

The guidelines set out in INDG382 cover aspects such as routes, scheduling, speeding, long working hours or driving long distances (both leading to fatigue) and systems to monitor and assess risk and actual performance.


The Duty of Care and Compliance Module
